Learning Objectives

  • To show participants that land matters are affected by a variety of laws and not merely the NLC 1965.
  • To show participants how the Torrens system is applied in Malaysia and what is/is not protected by registration.
  • To show participants the various types of security transactions that are currently practiced in Malaysia.
  • To show participants the procedures for registration and remedies of chargees.
  • To show participants the nature and characteristics of liens and prohibitory orders.
  • To provide an outline of various security transactions outside the National land Code 1965 and the means of enforcing them.

Learning Outcome

  • Participants will have a greater awareness and appreciation of how the law works in totality and how it affects land law in Malaysia
  • Participants will realize the importance of registration and the limited titles and interests that may be protected.
  • Participants will be aware of the suitability and respective advantages and disadvantages of the different types of security transactions.
  • Participants will be aware of the importance of registration of charges and the various steps to be taken in realizing the security.
  • Participants will have a greater understanding and awareness of liens and prohibitory orders and the method of enforcing them.
  • Participants will have an understanding of security transactions outside the National Land Code 1965, their strengths and weaknesses and the proper safeguards to be employed.

In this session, participants will understand the following:

 

·                     Torrens system of registration and indefeasibility

·                     What constitutes registration

·                     Conclusive effect of the register

·                     Dealings registrable under the National Land Code 1965

·                     Transactions provided protection despite non-registrability

·                     Transactions outside and beyond the register

·                     Rights and Duties of purchasers

·                     As is where is basis – rights of purchasers
